Prescription Drug Affordability Review Board and Advisory Council

The Governor’s Office of Boards and Commissions and the Division of Insurance are accepting applications for both the Colorado Prescription Drug Affordability Review Board AND the Colorado Prescription Drug Affordability Advisory Council.

The Prescription Drug Affordability Review Board and the Prescription Drug Affordability Advisory Council were both established by Senate Bill 21-175, a bill that was signed into law by Governor Polis. They are designed to efficiently and effectively save Coloradans money on prescription drugs and bring transparency to high drug costs in our state.

Colorado Prescription Drug Affordability Review Board
The Board will have five members, appointed by the Governor, and members will be subject to confirmation by the Colorado Senate. Two members will have an initial three-year term, two members will have an initial two-year term, and one member will have a one-year initial term. After initial terms, all subsequent board members will have three-year terms. The Board must be appointed by Oct. 1, 2021.

Applicant Requirements

  • An advanced degree and experience or expertise in health-care economics or clinical medicine;
  • Must not be an employee, board member, or consultant of: a manufacturer or a trade association of manufacturers; a carrier or a trade association of carriers; or a pharmacy benefit manager or a trade association of pharmacy benefit managers.

Conflicts of Interest

  • Applicants shall disclose any possible conflict of interest and this may be considered in deciding to appoint an applicant to the Board.
  • Board members shall recuse themselves from any board activity in any case in which they have a conflict of interest, and such conflicts of interest must be disclosed publicly.
  • Board members cannot accept financial benefits or gifts, bequests, or donations of services or property that suggest a conflict of interest or have the appearance of creating bias in the work of the Board.

Colorado Prescription Drug Affordability Advisory Council
The Colorado Prescription Drug Affordability Advisory Council will provide stakeholder input to the Board regarding the affordability of prescription drugs. Members will serve three-year terms, except for members initially appointed to the Council who will serve initial terms of two years. All Council members must be appointed by January 1, 2022. The Council will meet every three months.

Applicant Requirements
Council members must have knowledge of at least one of the following subject matters:

  • the pharmaceutical business model;
  • supply chain business models;
  • the practice of medicine or clinical training;
  • health-care consumer or patient perspectives;
  • health-care cost trends and drivers;
  • clinical and health services research;
  • the state's health-care marketplace.

Conflicts of Interest

  • Applicants shall disclose any possible conflict of interest. The Board may consider such conflicts in deciding to appoint an applicant to the Council.
  • The chair of the Council must report to the Board any conflicts of interest of the Council and these must be disclosed publicly.

Make-up of the Council
The Council will consist of 15 members. One member of the Council must be the Executive Director of the Department of Health Care Policy & Financing or their designee.

The remaining 14 members are appointed by the Board and must include the following:

  • two members who are health-care consumers or who represent health-care consumers;
  • one member representing a statewide health-care consumer advocacy organization;
  • one member representing health-care consumers who are living with chronic diseases;
  • one member representing a labor union;
  • one member representing employers;
  • one member representing health insurance carriers;
  • one member representing pharmacy benefit management firms;
  • one member representing health-care professionals with prescribing authority;
  • one member who is employed by an organization that performs research concerning prescription drugs, including research concerning pricing information;
  • one member representing manufacturers of brand-name drugs;
  • one member representing manufacturers of generic drugs;
  • one member representing pharmacists; and
  • one member representing wholesalers.

To the extent possible, the Board will appoint Council members who have experience serving underserved communities and reflect the diversity of the state with regard to race, ethnicity, immigration status, income, wealth, disability, age, gender identity, and geography.

In regards to geographic diversity, the Board shall ensure at least one Council member resides on the Eastern Plains and one member resides on the Western Slope. Additionally, the Board will work to appoint members from each Congressional district in the state.

While there is no formal deadline for applicants, Board applicants are highly encouraged to apply no later than August 15th, and Advisory Council applicants no later than October 1st.
