Enforcing premium reductions

Carriers operating in the Colorado individual and small group markets must offer a Colorado Option Standardized Plan (“CO Option Plan”) at the bronze, silver, and gold metal levels in counties where they offer non-CO Option Plans. A carrier must file CO Option Plan premium rates with the Commissioner of Insurance at reduced premiums consistent with the premium rate reduction requirements in § 10-16-1305(2), C.R.S. If a carrier cannot reduce premiums for consumers, the Commissioner of Insurance may hold a public hearing.

Public Hearings for CO Option Plans that fail to meet the premium rate reduction and network adequacy requirements will be held by the Commissioner during the Summer of 2023 for the 2024 plan year. This webpage will allow stakeholders to access the public hearing schedule and related documents, as they become available.

  • For individuals / entities that want to be admitted as parties regarding any complaints and pleadings connected to the Colorado Option filings.
  • Form should be downloaded, completed and submitted submitted to the Colorado Insurance Commissioner by email at: dora_hearingscoloradooption@state.co.us.
  • Form MUST BE SUBMITTED within seven (7) days from the date the complaint is posted on the Division’s website.

Hearing Schedule

All Public Hearings Concerning 2024 Rate Reductions for Both Individual & Small Group Colorado Option Plans Were Vacated

All of the company-specific hearings were vacated, as the parties (the insurance companies and hospitals) were able to negotiate and reduce provider reimbursement rates to the maximum allowed under statute. Because of this, the Division's requested relief was achieved, and therefore the need for adjudicatory hearings was no longer required.

Public Comment Hearings regarding premium reductions for Colorado Option plans were held on July 6 (for the small group market) and on July 7, 2023 (for the individual market). 

  • Pursuant to orders signed by the Commissioner of Insurance on May 31 and June 9, in Proceeding No. 2023-COH-001, In the Matter of Premium Rate Reduction for Standardized Individual Market Health Plan Year 2024 of Cigna Health and Life Insurance Company, the public hearings scheduled for June 6 and June 13 have been vacated.
  • Pursuant to an order signed by the Commissioner of Insurance on June 13, 2023, in Proceeding No. 2023-COH-003, In the Matter of Premium Rate Reduction for Standardized Individual Market Health Plan Year 2024 of Kaiser Foundation Health Plan of Colorado, the public hearings scheduled for June 21 and June 28 have been vacated.
  • Pursuant to an order signed by the Commissioner of Insurance on June 20, 2023, in Proceeding No. 2023-COH-004, In the Matter of Premium Rate Reduction for Standardized Individual Market Health Plan Year 2024 of HMO Colorado, Inc (Anthem), the public hearings scheduled for June 29 and June 30 have been vacated.
  • Pursuant to an order signed by the Commissioner of Insurance on June 22, 2023, in Proceeding No. 2023-COH-002, In the Matter of Premium Rate Reduction for Standardized Individual Market Health Plan Year 2024 of Rocky Mountain HMO, the public hearings scheduled for June 27 and June 28 have been vacated.
  • ALL hearings for the Small Group plans have been vacated
