The Division would like to provide notice that the Commissioner has adopted the following new bulletins:

The purpose of this bulletin is to clarify the Division’s position regarding carriers’ treatment of any deductible and maximum out-of-pocket accumulations when an individual already enrolled in a health benefit plan chooses to enroll in a new health benefit plan through the Exchange during the Special Enrollment Period (SEP).

This bulletin is intended to provide guidance to all carriers that issue individual health benefit plans in 2021.

The purpose of this bulletin is to provide guidance for insurance producers to provide written notice to all covered persons whom the insurance producer sold an off-Exchange health benefit plan regarding their potential eligibility for PTC due to the ARP. Allowing individuals to replace their off-Exchange health benefit plan with an on-Exchange health benefit plan is imperative to the financial welfare and preservation of the health of the citizens of Colorado.

This bulletin is intended to provide guidance to all producers who sold a currently in-force off-Exchange individual health benefit plan subject to the insurance laws of Colorado.
