Notice of Adoption - New Bulletin B-4.119 Policy Directives for COVID-19 Vaccine Severe Reactions and Revised Bulletin B-4.79 Off-Exchange Renewal and Re-determination Notices for Use by Carriers

The Division would like to provide notice that the Commissioner has adopted the following new bulletin:

The federal government has declared a national COVID-19 public health emergency that is likely to remain in place for the entirety of 2021. On July 8, 2021, Governor Polis issued Executive Order D 2021 122, Colorado COVID-19 Disaster Recovery Order and extended and amended that order on October 4, 2021 with Executive Order D 2021 132. That Order ensures   Coloradans can continue getting the life-saving, effective, and safe vaccine, secures resources to effectively treat COVID-19 patients, and continues access to federal resources. Making the COVID-19 vaccine as accessible as possible is critical to the State’s continued recovery efforts.

Although extremely unlikely, some individuals may experience a severe adverse reaction requiring medical attention as a result of a COVID-19 vaccine. In those rare instances, the purpose of this bulletin is to encourage carriers to provide coverage without cost sharing for adverse reactions as a result of a COVID-19 vaccine and to provide assistance to enrollees in seeking compensation under the Countermeasures Injury Compensation Program (CICP). The CICP was created to help in the very rare circumstance of someone experiencing a serious injury that is the result of a “covered countermeasure.” A countermeasure is a vaccination, medication, device, or other item recommended to diagnose, prevent or treat a declared pandemic, epidemic or security threat. COVID-19 vaccines are considered a covered countermeasure under the CICP.

The Division would like to provide notice that the Commissioner has adopted the following revised bulletin:

The purpose of this bulletin is to provide the template for the notice to be sent by carriers to provide individual health benefit plan policyholders with information regarding the renewal status of their current plan for the next plan year and the current plan’s estimated premium for the next plan year, when applicable.

This bulletins were adopted on October 29, 2021.
