The Division would like to provide notice that the Commissioner has adopted the following  regulations:

The purpose of this regulation is to establish requirements regarding the offering of Colorado Option Standardized Plans in the small group market.

Under § 10-4-1809(1)(b), C.R.S. and § 10-4-1809(2)(b), member insurers may, but are not required to, recoup fees paid to the Colorado FAIR Plan directly from their policyholders. If a member insurer chooses to recoup the fee, this regulation establishes the process for the recoupment of startup costs levied on member insurers participating in the Colorado FAIR Plan, ensuring financial stability while maintaining transparency and fairness to policyholders, pursuant to § 10-4-1809, C.R.S.

These regulations are effective on July 15, 2025.
