Commercial Insurance Resources for Colorado Providers

The Colorado Division of Insurance often receives complaints from a wide variety of health care providers relating to challenges, questions, comments, concerns that they have had regarding commercial insurance companies, reimbursements, credentialing, and network status. Many of these inquiries and complaints have been submitted to the Division through the Consumer Complaints Portal on the Division's website. It should be noted that the Consumer Complaint Portal is intended for consumer complaints, not provider complaints

 

In an effort to coordinate and manage provider complaints and issues more effectively, the Division is requesting providers to not submit complaints via the consumer complaint portal. (Exception: the provider has a release of information signed by their client to provide confidential information on their client’s behalf). Instead, the Division is providing resources for providers to review on this webpage alongside additional steps to take should their carrier complaints fall within the Division’s jurisdiction.

 

In support of the Division’s enforcement of the Mental Health Parity and Addiction Equity Act (MHPAEA), the Division specifically asks that all behavioral health providers who may have questions, comments, concerns, and/or complaints regarding commercial insurance to please visit our Resources for Behavioral Health Providers webpage.

Overview of Division of Insurance Regulatory Authority Regarding Provider/Carrier issues

Note: In most instances, the Division of Insurance is not permitted to arbitrate, mediate, or settle disputes between a carrier and a provider arising under or by reason of a provider contract or its termination, or a provider’s inclusion or termination from a network (§ 10-16-121(4), C.R.S.). Existing dispute resolution mechanisms, such as the mechanism found in Colorado Insurance Regulation 4-2-23, and those available in contract law shall be used to resolve such disputes.

Additionally, the Division of Insurance cannot become involved in complaints that relate to ongoing litigation.
