On August 8, 2022, the Division of Insurance held a public meeting to hear comments, concerns, and questions on the Division’s draft emergency regulation to collect Health Care Sharing Plan or Arrangement data per House Bill 22-1269 (HB22-1269). Commenters at the August 8th meeting raised concerns with the complexity of collecting the required data and ensuring consistent data quality across all plans and arrangements required to report to the Division.
Based on the stakeholder feedback received at the August 8th meeting, the written comments received, and to ensure all interested parties are able to provide feedback, the Division of Insurance will not enforce the October 1, 2022, reporting deadline, but instead will require Health Care Sharing Plans or Arrangements subject to the regulation to submit the first round of data by December 15, 2022, by 5:00 pm MT.
Additionally, the Division will host a second virtual public stakeholder meeting on October 4, 2022, at 12:00 noon MT, to hear and discuss feedback on the draft emergency regulation. This meeting will be held on Zoom. At this meeting the Division will also review the amended timeline to collect 2021 data from Health Care Sharing Plans or Arrangements.

The purpose of the draft emergency regulation is to establish the data reporting requirements applicable to all Health Care Sharing Plans Arrangements offering or that intend to offer plans or arrangements to facilitate payment or reimbursement of health care costs or services for residents of Colorado. HB22-1269 was signed by the Governor on June 8, 2022; the law requires all Health Care Sharing Plans or Arrangements offering or that intend to offer plans or arrangements to facilitate payment or reimbursement of health care costs or services for residents of Colorado to provide the Division with the data elements identified in the law.
