Request for Comment on DRAFT Proposed Amended Regulation 4-2-20 - Concerning the Summary of Benefits and Coverage Form and the Colorado Supplement to the Summary of Benefits and Coverage Form

The Division is seeking comments on the following draft proposed amended regulation:

• DRAFT Proposed Amended Regulation 4-2-20 Concerning the Summary of Benefits and Coverage Form and the Colorado Supplement to the Summary of Benefits and Coverage Form

The purpose of this regulation is to coordinate the requirements of § 10-16-108.5(11), C.R.S. and certain provisions of the Patient Protection and Affordable Care Act of 2010, Pub. L. No. 111-148, 124 Stat. 119 (2010) and the Health Care and Education Reconciliation Act of 2010, Pub. L. No. 111-152, 124 Stat. 1029 (2010), together referred to as the “Affordable Care Act” (ACA). This regulation also sets out procedures for carriers to make available the required Summary of Benefits and Coverage (SBC) and a Colorado Supplement to the Summary of Benefits and Coverage (COSSBC) Form for each policy, contract, and plan of health benefits that either covers a Colorado resident or is marketed to a Colorado resident or such resident's employer.

This regulation is being amended to revise citations to relevant federal statutes, clarify the location of the Division's SBC filing instructions, and require the availability of SBC and COSSBC forms in Spanish.

The Division is requesting informal comments be submitted to DORA_INS_RulesandRecords@state.co.us no later than 5 PM, March 23, 2021.
