The Division is seeking comments on the following draft proposed amended regulation:
The purpose of this regulation is to establish the requirements, processes, and forms to be utilized by carriers to ensure compliance with §§ 10-16-104(5.5) and 10-16-147, C.R.S., and the Mental Health Parity and Addiction Equity Act of 2008 (MHPAEA as defined at § 10-16-102(43.5), C.R.S.).
This regulation is being amended to update reporting requirements and align with statutory requirements and the new federal regulation.
Carriers are required to submit mental health parity data annually through different templates, as specified in this regulation. The reporting templates will be amended and revised based on the information included in the final regulation promulgated. The Division will provide a series of technical assistance webinars and written instructions to assist carriers in the preparation and completion of revised templates prior to submission deadlines. Additionally, the Division hosted a Town Hall meeting with carriers on March 5, 2024 to receive input on mental health parity reporting processes and procedures, and it will include such input in template revisions
The Division is requesting comments be submitted no later than 5 PM, October 8, 2024, to DORA_INS_RulesandRecords@state.co.us.
