Request for Comment on DRAFT Proposed Amended Regulations 4-2-42 Concerning Essential Health Benefits and 4-9-2 Credit Insurance

The Division is seeking comments on the following draft proposed amended regulations:

The purpose of this regulation is to establish rules for the required inclusion of the essential health benefits in individual and small group health benefit plans in accordance with Article 16 of Title 10 of the Colorado Revised Statutes, and the Patient Protection and Affordable Care Act of 2010, Pub. L. No. 111- 148, 124 Stat. 119 (2010) and the Health Care and Education Reconciliation Act of 2010, Pub. L. No. 111-152, 124 Stat. 1029 (2010), together referred to as the “Affordable Care Act” (ACA).

This regulation was released for external comment on March 9, 2022 and revisions were made based on the feedback received. This regulation is being updated to include the benefits in Colorado's benchmark plan, as approved by the Centers for Medicare and Medicaid Services in October 2021, for the 2023 plan year and to remove sections that are duplicative of federal law. 

The purpose of this regulation is to implement component rating and provide standards to enforce the provisions of Colorado Revised Statutes Article 10 of Title 10, regarding all forms of credit insurance.

This regulation is being amended to include additional filing submission requirements and detailed rate requirements for new and revised forms and annual reports. The regulation also adds a detailed list of the company officers who are qualified to sign the required certifications. 

The Division is requesting informal comments be submitted to DORA_INS_RulesandRecords@state.co.us no later than 5 PM, March 29, 2022.
