The Division is seeking informal comments on the following DRAFT proposed new bulletin:
During the 2020 legislative session, the Colorado General Assembly passed HB 20-1158 (Insurance Cover Infertility Diagnosis Treatment Preserve). Under 10-16-104(23) C.R.S, individual and group health benefit plans are required to provide coverage for the diagnosis and treatment for infertility and for standard preservation services except in the following circumstances:
- A religious employer may request an exemption if coverage conflicts with the employer’s bona fide religious beliefs and practices;
- For the individual and small group markets specifically, the coverage is found to constitute an additional benefit that requires state defrayal under the Affordable Care Act.
The purpose of this bulletin is to clarify the Division's position regarding coverage for infertility treatment and preservation services for a covered person in accordance with HB 20-1158.
The Division is requesting informal comments be submitted to DORA_INS_RulesandRecords@state.co.us no later than 5 PM, June 25, 2021.
