Request for Comment on DRAFT Proposed New Bulletin B-4.11X Transfer of Cost Sharing Accumulations during Special Enrollment Period

The Division is seeking informal comments on the following DRAFT proposed new bulletin:

Passage of the American Rescue Plan Act of 2021(ARP) significantly expands and increases individuals’ eligibility for advance premium tax credits (APTC) when they enroll in a health benefit plan through the Exchange. Individuals currently enrolled in a health benefit plan may qualify for increased APTC based on the ARP. However, such individuals may be concerned that enrolling in a new health benefit plan will jeopardize any deductible and maximum out-of-pocket amounts they have already accumulated in 2021, and therefore diminish or eliminate the financial incentive created by the ARP to enroll in a new health benefit plan during the SEP.

The purpose of this bulletin is to clarify the Division’s position regarding carriers’ treatment of any deductible and maximum out-of-pocket accumulations when an individual already enrolled in a health benefit plan chooses to enroll in a new health benefit plan through the Exchange during the SEP. It is imperative for the wellbeing of Coloradans that barriers to enrollment in a new on-Exchange health benefit plan be mitigated as much as possible.

The Division is requesting informal comments be submitted to DORA_INS_RulesandRecords@state.co.us no later than 5 PM, April 28, 2021.
