Request for Comment on DRAFT Proposed New Bulletin B-4.1XX Concerning Deadline Extension for Prior Authorization Reporting Required by Colorado Insurance Regulation 4-2-101

The Division is seeking comments on the following draft proposed new bulletin:

In 2024, the Colorado General Assembly passed House Bill 24-1149 (HB 24-1149) concerning modifications to requirements for prior authorization of benefits under health benefit plans. The legislation requires carriers to post, on a public facing portion of their website, data on the number of approvals and denials of prior authorization requests and data on exemptions offered from prior authorization requirements. The Division is required to adopt rules to ensure the data fields are presented consistently by carriers, and to define categories of prior authorization request denials. As a result, the Division adopted Colorado Insurance Regulation 4-2-101, which is effective January 1, 2026. The adopted regulation includes two new data templates for carriers to utilize when posting prior authorization data.

The purpose of this bulletin is to clarify the Division's position regarding the deadline for the required reporting of prior authorization data and exemptions required by HB 24-1149 and Colorado Insurance Regulation 4-2-101.
