The Division is seeking informal comments on the following DRAFT proposed new bulletin:

Colorado voters approved the Paid Family and Medical Leave (PFML) Insurance Program, Proposition 118, in November 2020, creating a Paid Family and Medical Leave Insurance (FAMLI) program. The FAMLI program will ensure all Colorado workers have access to paid leave in order to take care of themselves during life circumstances, such as growing their family, or taking care of a loved one with a serious health condition. FAMLI will start providing benefits to employees beginning January 1, 2024. The FAMLI program is designed to provide a necessary safety net for all Colorado workers.

The purpose of this bulletin is to clarify the Division of Insurance's (Division) role and the insurance product filing process for fully-insured private plans that Colorado employers will be allowed to select to provide paid family and medical leave, in accordance with § 8-13.3-521(2)(c), C.R.S. The FAMLI Division must approve an employer’s use of a fully-insured private insurance plan.

The Division is requesting informal comments be submitted no later than 5 PM, December 2, 2022, to DORA_INS_RulesandRecords@state.co.us.

This proposed draft bulletin, as well as other draft bulletins currently released for informal public comment, can be found on the Division's Draft Regulations and Bulletins for Informal Public Comment website.

Other Division bulletins currently in effect can be found on the Division's Colorado Insurance Bulletins website.
