Division of Insurance Adopts Hospital Fee Regulation

Fee from hospitals will be due July 31, 2021. 

DENVER (March 3, 2020) – Today, the Colorado Division of Insurance (DOI), part of the Department of Regulatory Agencies (DORA), adopted Regulation 4-2-69 “Concerning Hospital Special Fee Collection for the Colorado Reinsurance Program." Specifically, this regulation concerns when the DOI will collect a special hospital assessment fee from Colorado hospitals to fund the Reinsurance Program

For 2020, each hospital shall pay its portion of the fee by July 31, 2021. This due date is a change from the date of June 30, 2020, that was originally proposed. 

“We worked collaboratively with stakeholders through a public hearing and comment period to develop this final regulation. This regulation will help the reinsurance program bring relief to thousands of Coloradans, help sustain dramatic premium savings across the state, and defray costs for rural, independent and critical access hospitals,” said Insurance Commissioner Michael Conway. 

The amount of the fee depends on what the Federal government allows for all State-required fees from Colorado hospitals. Now that it’s 2020, the State can better estimate the amount of fees allowed compared to the estimate available when the reinsurance program bill first passed in 2019. 

Colorado’s reinsurance program is a bipartisan policy for the individual health insurance market that brought premiums down an average of 20.2% this year. The reinsurance program was enabled by legislation passed by the Colorado Legislature in the 2019 session. The State applied to the Federal government to run a reinsurance program with state and federal funding, and the U.S. Department of Health and Human Services approved Colorado’s application on July 31 2019.
