The Division would like to provide notice that the Commissioner has adopted the following bulletins:
The ongoing federal government shutdown has resulted in almost 57,000 federal employees and their families in Colorado being threatened with furloughs or being forced to work without pay. The purpose of this Bulletin is to urge carriers to take actions to avoid cancellations, lapses in coverage or late fees for federal employees affected by the federal shutdown.
During the 2023 legislative session, the Colorado State legislature passed Senate Bill (SB) 23-189, which requires carriers to provide coverage for the total cost of abortion care without requiring any cost sharing from enrollees. Carriers offering individual and small group health benefit plans began coverage of abortion care starting on January 1, 2025.
The purpose of this bulletin is to clarify the Division's position regarding payments to carriers related to the coverage for abortion services for individuals enrolled in on-Exchange plans.
The Division has received inquiries from life insurers regarding the requirement specified in Section 5.A.11. of Colorado Insurance Regulation 10-1-1 to include a description of the quantitative testing conducted to detect unfair discrimination in the annual report due December 1, 2024. Life insurers are requesting guidance due to the fact that the Division has not yet adopted rules establishing the required quantitative testing. The purpose of this bulletin is to provide the requested guidance.
