Notice of Adoption of Emergency Regulation 20-E-17 - Concerning Coverage and Reimbursement for COVID-19 Treatment and Vaccines During the COVID-19 Disaster Emergency

The Division would like to notify interested stakeholders that the Commissioner of Insurance has adopted the following emergency regulation:

The purpose of this emergency regulation is to require carriers to provide covered persons with treatment related to COVID-19 and access to COVID-19 vaccines without cost-sharing. This emergency regulation also ensures that out-of-network providers rendering emergency services for emergency medical conditions, including but not limited to COVID-19, are appropriately compensated pursuant to § 10-16-704(5.5), C.R.S., without delay. This regulation shall remain in effect for 120 days or during any period in which a disaster declaration is in effect in the state of Colorado due to the presence of COVID-19, whichever is shorter.

This emergency regulation replaces emergency regulation 20-E-12. It extends the timeframe for the requirements in emergency regulation 20-E-12 and includes requirements around the coverage of COVID-19 vaccines without cost-sharing.
