New Reporting Deadline for 2024
In consideration of the effective date for regulation 4-10-01 and the statutorily required reporting deadline for health care sharing plans or arrangements submissions, the Division has delayed the March 1, 2024 reporting deadline to May 15, 2024.
This is the permamanet regulation to establish the data reporting requirements applicable to all health care sharing plans or arrangements (HCSPAs) offering or that intend to offer plans or arrangements to facilitate payment or reimbursement of health-care costs or services for residents of this state.
Health Care Sharing Plans or Arrangements Reporting Requirements
House Bill 22-1269 (HB22-1269) was signed by the Governor on June 8, 2022. The law requires all health care sharing associations offering, or that intend to offer, plans or arrangements to facilitate payment or reimbursement of health-care costs or services for residents of Colorado to provide the Division with the data by October 1, 2022 and by March 1 of each year thereafter.
Noncompliance may result in the imposition of any of the sanctions made available in the Colorado statutes pertaining to the business of insurance, or other laws, which include the imposition of civil penalties, issuance of cease and desist orders, subject to the requirements of due process.
The Division of Insurance created a data reporting template for Regulation 4-10-01 and for all applicable health care sharing associations operating in Colorado to use in fulfilling the data reporting requirements of Colorado Revised Statutes 10-16-107.4 and House Bill 22-1269.

The Division of Insurance held a virtual public meeting on Monday, August 8, 2022, via webinar to hear comments, concerns, and questions on the Division’s draft emergency regulation to collect data from Health Care Sharing Ministries and Associations per House Bill 22-1269 (HB22-1269).
The Division held a second virtual public stakeholder meeting on October 4, 2022 to hear and discuss feedback on the updated draft emergency regulation and updated template. At this meeting the Division reviewed the amended timeline to collect 2021 data from Health Care Sharing Plans or Arrangements.
- The Division of Insurance held a VIRTUAL Permanent Rulemaking Hearing on Friday, March 1, 2024 at 11:00 AM on the draft of proposed new regulation 4-10-01 Health Care Sharing Plan or Arrangement Reporting Requirements. Originally this hearing was scheduled for January 30, 2024. Ahead of the hearing, a cost benefit analysis was requested for this draft proposed regualtion, this cost benefit analysis can be found on the Division's website.
Once HCSA submissions are deemed complete all non-confidential materials will be added to this site. Timing to share these files is dependent upon the amount and quality of each submission.
