SB23-179 - Dental Plans Loss Ratio

On June 2, 2023, Governor Polis signed Senate Bill (SB) 23-179 into law to provide greater transparency on how premium dollars are spent by dental insurance plans. Loss ratios are calculations that are commonly used in the insurance industry, and represent the ratio of an insurance company's losses (or claims paid) to premiums earned. In July 2024, insurance companies offering dental coverage in Colorado began filing dental loss ratio (DLR) information with the Division. Details from these initial filings - including a list of insurance company filings, and an interactive display showing the aggregate DLRs reported by companies alongside other data elements required by statute - are available below. This information will be updated annually, and will allow Coloradans an opportunity to compare dental loss ratios across insurance companies.

Dental Loss Ratio Reporting Information - From Insurance Company Filings Submitted July 31, 2024

Pursuant to ยง 10-16-165. C.R.S., an insurance company that issues, sells, renews, or offers a dental coverage plan shall file a dental loss ratio form electronically with the Colorado Division of Insurance (DOI) for the preceding calendar year in which dental coverage was issued, sold, or renewed. Insurance company filings submitted for the initial reporting period, which were due on or before July 31, 2024, included data for complete plan years 2021, 2022, and 2023.

To allow members of the public to compare DLRs among companies, and in accordance with statutory requirements, the Division is providing the following resources, available at the following links: 

A list of dental insurance companies, with links to the company's DLR Reporting filings submitted through the System for Electronic Rate and Form Filings (or SERFF);
Detailed instructions on how to access the company filings in SERFF, which contain all DLR and associated data; and
An interactive display showing aggregate reported DLRs and other data elements

Stakeholder Meetings

The Division hosted a Dental Loss Ratio Reporting Requirements stakeholder meeting on October 5, 2023, to collect feedback regarding the establishment of Dental Loss Ratio (DLR) reporting requirements, pursuant to Senate Bill (SB) 23-179. This meeting allowed stakeholders an opportunity to provide comments and feedback on what issues the Division of Insurance should consider when drafting regulations to implement the DLR reporting requirements.

Oct 5, 2023 Stakeholder Meeting Materials

 

The Division hosted a second Dental Loss Ratio Reporting Requirements stakeholder meeting on January 18, 2024, to collect feedback regarding the Division's DRAFT Proposed New Insurance Regulation 4-2-XX Dental Loss Ratio Reporting Requirements. This meeting allowed stakeholders an opportunity to provide comments and feedback the draft proposed regulations, and considerations for how data should be reported to the Division.

Jan 18, 2024 Stakeholder Meeting Materials

The Division hosted a third Dental Loss Ratio Reporting Requirements stakeholder meeting on December 3, 2024, to provide updates on DLR implementation activities to date,  and to discuss the data that will be posted publicly on the Division's website no later than January 2, 2025. Stakeholders are invited to submit questions or comments to the proposed public posting documents to Tara Smith (tara.smith@state.co.us) and Deb Judy (debra.judy@state.co.us) by December 11, 2024.
