The Division would like to provide notice that the Commissioner has adopted the following amended regulation:
The purpose of this regulation is to provide carriers the guidance necessary to comply with the statutory requirements regarding the issuance and use of health benefit plan identification cards. This regulation is being amended to clarify certain state statutory requirements, and to to align state law with the requirements imposed by the No Surprises Act, part of the Consolidated Appropriations Act of 2021, Pub. L. No. 116-260, §§ 101–118, 134 Stat. 1182 (2020), and codified in 42 U.S.C. § 300gg-111(e).
This regulation will become effective on January 1, 2022.
