Request for Comment on DRAFT Proposed New Regulation 4-2-XX, and DRAFT Proposed Amended Regulations 4-2-82, 4-2-80, and 4-2-39

The Division is seeking comments on the following draft proposed regulations:

The purpose of this regulation is to establish the requirements for a carrier, offering a health benefit plan on the individual market that includes a prescription drug benefit, to make a modification to the prescription drug formulary during the current plan year pursuant to Section 10-16-122.4(2), C.R.S.

The purpose of this regulation is to provide carriers with the policyholder notice templates for plans that are being modified through the reasonable modifications process in accordance with Colorado Insurance Regulation 4-2-27, being discontinued in accordance with Colorado Insurance Regulation 4-2-51, or being continued without modification.

This regulation is being amended to add notice templates for carrier’s exit from the health insurance market, and modifications to current prescription drug formularies during the current plan year in accordance with Colorado Insurance Regulation 4-2-XX.

The purpose of this regulation is to provide carriers offering the Colorado Option standardized bronze, silver, and gold health benefit plans with the requirements to offer a culturally responsive network of providers and the action plan elements if the network does not meet these standards as required by 10- 16-1304(2), C.R.S.

This regulation is being amended to make changes to the required carrier attestations and reporting. 

The purpose of this regulation is to provide the necessary guidance to carriers to ensure that health insurance rates comply with Colorado’s health benefit plan rating laws.

This regulation is being amended to incorporate language from Bulletin 4.116, clarify use of penalties, and require AV Certification for Colorado Option Standardized Plans.
