The Division is seeking comments on the following draft repealed and repromulgated regulation:
The purpose of this regulation is to provide the necessary guidance to carriers to ensure that health insurance rates comply with Colorado’s health benefit plan rating laws. This regulation replaces Repealed Colorado Insurance Regulation 4-2-39 that had become effective on October 15, 2018.
This regulation is being repealed and repromulgated to specify rate filing requirements by line of business. Section 6 specifies Individual and Small Group Rate Filing Requirements, Section 7 specifies Large Group Rate Filing Requirements, Section 8 specifies Student Health Rate Filing Requirements, and Section 9 specifies Pediatric Stand-Alone Dental Rate Filing Requirements. In addition, this regulation updates requirements based on recent law changes due to HB19-1174 and SB 20-215, which are located in the "Retention Schedule" section and the "Out-Of-Network Claims Payment" section for all applicable lines of business.
The Division is requesting informal comments be submitted to DORA_INS_RulesandRecords@state.co.us no later than 5 PM, January 27, 2021.
